Welcome to Jamacast.com. Jamacast provides a service and personal use Web site to you the "User", subject to the following Terms of Use. The use of this Web Site constitutes a contract between you and Jamacast.com for the use of Services only. Unless expressly stated otherwise, these Terms of Use shall apply to any use of the Jamacast.com Web Site.

By visiting the Jamacast.com Web Site and/or by completing the registration process for the Services, you represent and warrant that you have read, understand, have the legal capacity to, and hereby agree to be legally bound by these Terms of Use. Jamacast.com is available ONLY TO USERS 18 YEARS OF AGE OR OLDER.

CONSENT TO ELECTRONIC COMMUNICATIONS AND SOLICITATION.
By registering with Jamacast.com, you understand that we may send you communications or data from Jamacast.com regarding the Services listed below
(1) notices about your use of Services, such as notices concerning violations of use

(2) updates

(3) promotional information and materials regarding Jamacast.com's products and services, via Email.

USER CONDUCT/ACCEPTABLE USE POLICY.
You may not use the Services in any way that violates applicable federal, state, or international law. You may not use the Services to send, receive, or download messages or materials that are inappropriate or violate the intellectual property rights of others.

PRIVACY.
You acknowledge and agree that Jamacast.com may disclose your personal information for Law Enforcement to comply with legal processes, to enforce Jamacast.com Terms of Use policy, or to protect the rights, property, or personal safety of Jamacast.com, its users and third parties, and the general public.

By signing up as a user on jamacast.com, you have the choice of becoming a Fan, Musician or a Record Label/Band Promoter type of user. A Fan and a Record Label/Band Promoter type user has limited functionality on this site. A Fan and Record Label/Band Promoter type user does not have the ability to upload audio files to Jamacast.com, but does have the ability to link to off sites via other methods. A Fan and Record Label/Band Promoter type user has the ability to create Blogs and Forum posts and view other Blogs and comments on the forum. With a Musician type account you will be able to upload your own original work audio files for which you own the copyright for or license to use from the copyright holders. As a Musician type user account, you will also be able to participate in the Jamacast Collective Collaboration Projects and Meetings, as well as be a part of the Advertisement revenue sharing program. In order for a Musician user type account to be eligible for receiving Advertisement Revenue, they must be an actively participating member who is a musician. The requirements to be considered an actively participating member who is a musician are as follows:
1) The Musician User Account must not be in a blocked user or deleted user status.
2) The Musician User Account must actively log into the system at least one time within a six month period from their last login period.
3) The Musician user Account must post at least one audio upload file of their own original music score, song, or Work In Progress (WIP) within a six month period from their last audio upload or from their initial user registration date.
4) The Musician user Account can not have more than one Musician user account. Jamacast only allows one physical person per account, this physical person can not have more than one Musician type user account. 5) In order to be eligible to receive a payment for ad revenue sharing. The Musician user account must have a valid Paypal account. This Paypal account can only be used for one Musician type user account and not shared with any other type of user account.
Any person who has signed up for a user account on jamacast.com, and has not logged into their account at least one time within the first six months of registering, will be removed from jamacast.com.
This "Terms Of Service (TOS)" is subject to change from time to time, with or with out notice. You the user have the right to disagree and terminate your account at anytime. You can request to be removed via using the site administrators (MADMAX's) email contact form. You may also request removal via email jamacast@jamacast.com.
In order to sign up as a Record Label/Band Promoter type user account. You must first contact (MADMAX) who is an administrator of Jamacast.com via private message after you have signed up as either a Fan or Musician / Band type of user account. Jamacast will then need to verify and pre approve this type of an account for you.
